Under Law No 1225/1992 on the rehabilitation of victims of communist repression, rehabilitated persons or their heirs may request the restitution of property or its value illegally confiscated or otherwise removed from their possession.

The restitution of illegally confiscated property or its value can be obtained after adequate documentation in the state and municipal/racial archives, rehabilitation of the victim subjected to political repression, obtaining civil status documents and, where appropriate, the certificate of inheritance, valuation of confiscated property, submission of the case to the Special Commission and, where appropriate, of the application for legal action (e.g. Colgiu Eleonora v. Sângerei District Council).
